Terms and Conditions — PhysicsNP
1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and PhysicsNP ("PhysicsNP," "we," "us," or "our"), a physics learning platform operated from Chitwan, Nepal, providing structured courses and past papers for students following the NEB (National Examinations Board) and CBSE (Central Board of Secondary Education) curricula.
By creating an account, accessing, or using the PhysicsNP platform, website, or related services (collectively, the "Service"), you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, you must not access or use the Service.
If you are under the age of majority in your jurisdiction, you confirm that you have obtained permission from a parent or legal guardian to use the Service, or that you are using it under their supervision, in accordance with Section 13 (Minors and Parental Guidance).
2. Description of the Service
PhysicsNP provides:
- Structured physics courses aligned with the NEB and CBSE syllabi.
- Past examination papers and related study materials for physics students.
- A community presence on YouTube, where we share educational videos and engage with students.
- User accounts that allow you to track your learning progress, save preferences, and access personalized content.
2.1 The Service Is Free of Charge
PhysicsNP is provided to users entirely free of charge. We do not and will never charge for:
- Access to courses
- Access to past papers
- Any educational content, materials, or information available on the platform
We do not process payments, and the Service contains no premium tiers, paywalls, in-app purchases, or hidden charges of any kind. Should our business model ever change in the future, we will provide clear and prominent advance notice, and any change would only apply prospectively, never retroactively, and never to previously accessed content.
3. Eligibility
To use the Service, you must:
- Be capable of forming a legally binding contract, or have the consent/supervision of a parent or legal guardian if you are a minor;
- Provide accurate, current, and complete information during account registration;
- Use the Service only for lawful, educational purposes consistent with these Terms.
4. Account Registration and Security
4.1 Creating an Account
To access certain features of the Service (such as saving progress or accessing personalized content), you may be required to create an account by providing information such as your name, email address, and grade/board level.
4.2 Accuracy of Information
You agree to provide accurate and up-to-date information when creating and maintaining your account and to promptly update any information that becomes inaccurate.
4.3 Account Security
- You are responsible for maintaining the confidentiality of your account credentials (username and password).
- You are responsible for all activities that occur under your account.
- You agree to notify us immediately at support@physicsnp.com if you suspect any unauthorized use of your account or any other breach of security.
- We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
4.4 One Account Per User
Each user should maintain only one account. Creating multiple accounts to circumvent restrictions or abuse platform features is prohibited.
5. Acceptable Use Policy
By using the Service, you agree that you will not:
- Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law;
- Copy, reproduce, distribute, republish, or resell course content, past papers, or other materials for commercial purposes without our prior written consent;
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems and networks;
- Upload or transmit viruses, malware, or any other malicious code;
- Use automated systems (bots, scrapers, crawlers) to access or extract data from the Service without our express written permission;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Harass, abuse, threaten, or intimidate other users, particularly within community or comment features;
- Post or transmit any content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable;
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein;
- Reverse-engineer, decompile, or disassemble any portion of the Service, except where such restriction is prohibited by applicable law.
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including suspending or terminating the violator's account.
6. Intellectual Property Rights
6.1 Our Content
All course materials, past papers, text, graphics, logos, course structures, videos, and other content made available through the Service (collectively, "Content") are the property of PhysicsNP or our licensors and are protected by copyright, trademark, and other intellectual property laws of Nepal and applicable international treaties.
6.2 Limited License to You
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal, non-commercial, educational use.
You may not:
- Sell, license, rent, or otherwise commercially exploit the Content;
- Modify, adapt, or create derivative works from the Content without our written permission;
- Remove any copyright, trademark, or other proprietary notices from the Content;
- Redistribute past papers or course materials on other platforms, websites, or services without our prior written consent.
6.3 Third-Party and Public Examination Content
Some past papers made available on the Service may originate from official examination boards (NEB, CBSE) or other public sources. Such materials remain the intellectual property of their respective owners/boards, and PhysicsNP makes them available for educational reference purposes only. If you are a rights holder and believe content has been made available in a way that infringes your rights, please contact us at contact@physicsnp.com and we will investigate and take appropriate action, which may include removal.
6.4 User-Generated Content
If the Service allows you to submit comments, feedback, questions, or other content ("User Content"), you retain ownership of your User Content, but you grant PhysicsNP a worldwide, royalty-free, non-exclusive license to use, display, and reproduce that User Content solely for the purpose of operating, improving, and promoting the Service (e.g., displaying a helpful question in a course discussion section).
You represent that you own or have the necessary rights to any User Content you submit, and that it does not violate the rights of any third party.
7. YouTube Community and Third-Party Platforms
PhysicsNP maintains an official YouTube channel and community where we share educational videos related to our courses.
- Interaction with our YouTube content (subscribing, commenting, liking) is subject to YouTube's own Terms of Service and Privacy Policy, over which we have no control.
- Embedded or linked YouTube content is provided for your convenience and educational benefit; we are not responsible for the availability, accuracy, or content of third-party platforms.
- Any views, comments, or interactions you make in our YouTube community should remain respectful and on-topic; we reserve the right to moderate our own YouTube content and comments in accordance with YouTube's community guidelines and our own standards of conduct.
8. Availability, Modifications, and Interruptions
8.1 Service Availability
We strive to keep the Service available and functioning smoothly; however, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free at all times. The Service may occasionally be unavailable due to maintenance, technical issues, or circumstances beyond our control.
8.2 Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service (including specific courses, features, or past papers) at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation, provided that core educational content remains free as described in Section 2.1.
9. Disclaimers
9.1 Educational Purpose Only
The Content provided through PhysicsNP is intended for general educational and exam-preparation purposes only. While we strive for accuracy, we do not guarantee that:
- Course content or past papers are free from errors or omissions;
- Use of the Service will result in any specific examination outcome, grade, or result;
- Past papers or course materials perfectly reflect the current or future official NEB/CBSE syllabus or examination format.
Students should always refer to official NEB and CBSE board resources as the authoritative source for examination requirements.
9.2 "As Is" and "As Available"
THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- PhysicsNP, its founders, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of academic performance, or loss of opportunity, arising out of or related to your use of, or inability to use, the Service.
- Because the Service is provided entirely free of charge, our total aggregate liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us to access the Service — which, given the Service is free, means our liability is nominal to the fullest extent permitted by law.
- Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (such as liability for fraud or gross negligence).
11. Indemnification
You agree to indemnify, defend, and hold harmless PhysicsNP and its founders, staff, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Service;
- Your violation of these Terms;
- Your violation of any rights of a third party, including intellectual property or privacy rights;
- Any User Content you submit through the Service.
12. Termination
12.1 By You
You may stop using the Service and delete your account at any time by contacting us at contact@physicsnp.com.
12.2 By Us
We reserve the right to suspend or terminate your account and access to the Service, at our sole discretion, without prior notice, if:
- You violate these Terms or our Acceptable Use Policy;
- Your conduct may cause harm to other users, PhysicsNP, or third parties;
- We are required to do so by law;
- We discontinue the Service in whole or in part.
12.3 Effect of Termination
Upon termination, your right to access and use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including intellectual property provisions, disclaimers, limitation of liability, and indemnification) will survive.
13. Minors and Parental Guidance
Given that PhysicsNP primarily serves secondary school students preparing for NEB and CBSE examinations, some users may be minors.
- We encourage parents and guardians to be involved in and aware of their child's use of the Service.
- The Service does not contain any payment features, in-app purchases, or age-inappropriate content, and it is designed to be a safe educational environment.
- Parents or guardians who wish to review, manage, or delete their child's account information may contact us directly at support@physicsnp.com.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information, and confirms that we do not share your data with third-party providers or advertisers. Please review our Privacy Policy carefully, as it is incorporated into these Terms by reference.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict-of-law provisions.
15.2 Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the matter amicably through direct communication by contacting contact@physicsnp.com. If a resolution cannot be reached, the dispute shall be subject to the exclusive jurisdiction of the competent courts of Nepal.
16. Changes to These Terms
We reserve the right to modify or update these Terms at any time, at our sole discretion. When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms;
- Provide notice via email and/or a prominent notice within the Service, where the change is significant.
Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PhysicsNP regarding your use of the Service, and supersede any prior agreements or understandings, whether written or oral.
19. No Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of PhysicsNP.
